Declaration
| The Declaration is the "Constitution" by which the community lives. It provides the legal definition of the structures and common elements, the rights and responsibilities of the unit owners. It also provides the legal framework to which the Bylaws, Rules and resolutions must conform. The original 1990 document was restated and amended in 2005 to establish control of the community by the homeowners rather than the developer. A 2018 amendment established council boundaries. A 2021 amendment indemnified directors from covid related law suits. The amendment and the waiver are attached below for the record. Conservancy Board voted in March 2022 to modify restrictions to be compliant with guidance from state of Connecticut. The 2022 restated and amended declaration is currently in effect. It is attached below as the first download. |
